Terms and Conditions for Electronic Services

§ 1. Service Provider

The service provider is VIARTEM sp. z o.o., ul. Henryka Sienkiewicza 6, 72-320 Trzebiatow, Poland, KRS 0001052477, VAT ID/NIP 8571937218. Contact: kalkulator@viartem.pl, phone +48 518 095 280. The Application is available at https://kalkulator.viartem.pl.

§ 2. Definitions

Application — the VIARTEM ANALYTICS web application used to generate wind reports.
User — any natural person, legal person or organization using the Application.
Consumer — a natural person entering into a contract for purposes not directly related to their business or profession.
Entrepreneur with Consumer Rights — a natural person conducting business where the contract is related to that business but is not professional in nature for that person.
Report — a PDF wind analysis for a selected location and turbine set; digital content under consumer protection rules.
Credit — a unit entitling the User to generate one Report, acquired in a Package.
Package — a set of Credits purchased in one payment transaction.
Promo Code — a code enabling free or promotional Report generation.
Account — an individual user account.
Stripe — the external payment processor, Stripe Technology Europe Limited, Dublin, Ireland.

§ 3. General Provisions

These Terms govern the use of the Application, ordering and generating Reports, purchasing Packages, using Accounts and Promo Codes, complaints, withdrawal rights, and the parties' rights and obligations. The Terms are available free of charge at /terms/en and may be saved or printed.

Using the public pages of the Application constitutes acceptance of these Terms only to the extent that no active checkbox is required. Orders, Account registration and Report generation require explicit acceptance of the relevant checkboxes. Required technical conditions include an internet-enabled device, current web browser, active email address, JavaScript and necessary cookies.

§ 4. Services

Single Report without an Account — generation and delivery of a PDF Report for payment or a valid Promo Code.
User Account — account management, Package purchases, Report generation, Report history and custom power curves.
Credit Packages — prepaid Credits for multiple Report generations.
Custom Power Curves — registered users may define and store their own turbine technical data.

§ 5. Account Registration

Account registration is voluntary and requires an email address, hashed password, phone number and account type. A company account may include VAT ID/NIP. Users must provide truthful, current and complete data. Registration requires acceptance of the Terms and acknowledgement of the Privacy Policy. Marketing consent is separate and optional.

§ 6. Single Report without Account

A Single Report can be ordered at /single_report. The User provides an email address, a location by address or coordinates, selects a turbine group, accepts the required legal checkboxes and pays via Stripe or enters a valid Promo Code. Paid Reports may be downloaded or sent by email. Promo-code Reports are delivered by email only. The Single Report price is PLN 15.99 gross. If generation fails due to a technical fault on VIARTEM's side, VIARTEM will refund the payment within 14 days or regenerate the Report.

§ 7. Credit Packages and Account Reports

Credits are prepaid entitlements for future Reports. They are not electronic money or vouchers, cannot be exchanged for cash and cannot be transferred to another User. Credits are valid for 24 months from Package purchase. One successfully generated Report consumes one Credit. A Credit is not consumed if Report generation fails due to a technical fault on VIARTEM's side.

Consumers and Entrepreneurs with Consumer Rights may withdraw from a Package purchase within 14 days if no Credit from the Package has been used.

§ 8. Promo Codes

Promo Codes are marketing tools intended for specific audiences, such as VIARTEM Shop customers or remarketing participants. A code may have an expiry date, usage limit, per-email limit or specific purpose. It cannot be exchanged for cash, resold or transferred. Once the Report has been generated and sent, the service is fully performed and the Promo Code is redeemed. VIARTEM may deactivate a code in case of abuse, technical error or campaign end.

§ 9. Payments and Invoices

Payments are processed by Stripe. VIARTEM does not store payment card data. Available payment methods are determined by Stripe and may include cards and BLIK. All prices are gross prices. A contract is concluded when Stripe confirms payment and the Report is generated or Credits are added to the Account. Business Users may request a VAT invoice by contacting kalkulator@viartem.pl.

§ 10. Custom Power Curves

Registered Users may define up to 6 custom power curves. By submitting custom data, the User declares that the data is accurate and complete, that they have the right to use submitted names and data, and that they accept responsibility for technical correctness. VIARTEM performs only basic range validation and does not verify custom data against manufacturer documentation.

§ 11. Nature and Limitations of Reports

Reports are informational and analytical only. They are not a technical design, technical expert opinion, bank-grade audit, yield guarantee, field measurement or standalone basis for an investment decision.

Reports are based on climate models and historical weather-station data. These data describe wider-area conditions and do not fully account for local obstacles, turbulence, buildings, trees, slopes, mast height, equipment quality, installation methods, cabling, service interruptions or system losses. Results are estimates and may differ from actual energy production. VIARTEM's liability towards B2B Entrepreneurs is limited to the order value, excluding lost profits, without limiting mandatory consumer rights.

§ 12. Data Sources and Attributions

Copernicus Climate Change Service / ECMWF / ERA5 — generated using Copernicus Climate Change Service information (2023). Neither the European Commission nor ECMWF is responsible for any use of the information or data.
Global Wind Atlas 3 — application and data developed by DTU in partnership with the World Bank Group, using Vortex data and ESMAP funding. GWA data is intended for preliminary site screening and does not replace on-site measurements or technical design.
Visual Crossing — historical weather-station data, as required by the applicable licence.
Turbine data — predefined Application data or data submitted by the User.

§ 13. Withdrawal Right

A PDF Report is digital content not supplied on a tangible medium. A Consumer generally has a 14-day withdrawal right for distance contracts. The Consumer loses the right to withdraw from the Report contract if they gave prior consent to immediate delivery before the withdrawal period expires, were informed that the right would be lost after performance, acknowledged this, and VIARTEM provided confirmation of the contract.

For paid Reports the User accepts the Terms and Privacy Policy and separately consents to immediate delivery and withdrawal-right loss after generation and delivery. For Promo Code Reports the User acknowledges that once generated and sent, the service is performed and the code is redeemed. For Credit Reports the User confirms immediate generation and permanent consumption of one Credit.

§ 14. Complaints

Complaints may be submitted to kalkulator@viartem.pl or VIARTEM's postal address. A complaint should include the User's name/company, order or Account email, order date or Stripe transaction number, issue description and requested resolution. VIARTEM responds within 14 days. Complaints may relate to formal PDF defects or technical errors. Complaints based only on differences between estimated and actual energy yield are not accepted due to the analytical nature of Reports.

§ 15. Consultations and Report Submission

After generating a Report, the User may voluntarily click “Request consultation — send report to VIARTEM”. This means a request for contact, authorization for VIARTEM to receive the Report PDF and processing of the email and location from the Report to handle the consultation request. Reports are not automatically sent to VIARTEM.

§ 16. Intellectual Property

Rights to the Application, software, graphic design, editorial content, calculation methodology and Report layout belong to VIARTEM or its licensors. Reports may be used for the User's private or professional purposes only and may not be resold, publicly distributed or commercially exploited without VIARTEM's consent.

§ 17. Privacy Policy

Personal data processing rules are described in the Privacy Policy.

§ 18. Final Provisions

These Terms are governed by Polish law. B2B disputes are resolved by the court competent for VIARTEM's registered seat. Consumer disputes are resolved under applicable consumer protection rules. The Polish version is legally binding.
